<h1 class="ql-align-center"><strong style="color: rgb(230, 0, 0);">Exemption under RTI&nbsp;</strong></h1><p class="ql-align-center"><br></p><h3><strong>Context&nbsp;</strong></h3><ul><li class="ql-indent-1">In a rare order, the <strong>Central Information Commission (CIC)</strong> has overruled the decision of the <strong>Central Reserve Police Force (CRPF)</strong> claiming exemption from disclosure of information sought under the <strong>Right to Information (RTI) Act, 2005.</strong></li></ul><h3><strong>About RTI Act, 2005&nbsp;</strong></h3><ul><li class="ql-indent-1">Right to Information Act or RTI is a central legislation, which enables the citizens to procure information from a public authority.</li><li class="ql-indent-1">It provides the mechanism for obtaining information under the control of public authority so that transparency and accountability can be increased.</li></ul><h3><strong>Exemption under RTI&nbsp;</strong></h3><ul><li class="ql-indent-1">Right to information under RTI Act 2005 is not absolute, it can be legitimately restricted in exceptional circumstances.</li><li class="ql-indent-1"><strong>Section 8 and 9 of the Act</strong> enumerate the categories of information which are exempt from disclosure.&nbsp;</li></ul><h3><strong>Sec 8 of the RTI ACT: Sec 8 deals with exemption from disclosure of information.</strong></h3><ul><li class="ql-indent-1">Information which would prejudicially affect the sovereignty and integrity of India</li><li class="ql-indent-1">Information which has been expressly forbidden to be published by any court of law</li><li class="ql-indent-1">Information, the disclosure of which would cause a breach of privilege of Parliament or the State Legislature.</li><li class="ql-indent-1">Information including commercial confidence, trade secrets or intellectual property, the disclosure of which would harm the competitive position of a third party, unless the competent authority is satisfied that larger public interest warrants the disclosure of such information</li><li class="ql-indent-1">Information available to a person in his fiduciary relationship, unless the competent authority is satisfied that the larger public interest warrants the disclosure of such information.</li></ul><p class="ql-align-center"><br></p><h1 class="ql-align-center"><strong>PRELIMS NOTES:</strong><a href="https://www.sunyaias.com/subscription-details/prelims-2023-sunya-notes-current-affairs" rel="noopener noreferrer" target="_blank" style="color: rgb(0, 102, 204);"><strong>CLICK HERE</strong></a></h1>
